This article discusses the legal aspects of customary law as norms governing society. But the
common law of the Kazakhs corresponded to the norms of the law, i.e. customary law had the norms of law that had the
force of law corresponding to the political systems of that society. Such common law was in all countries and they
protected human rights, and some laws were harsh, i.e. not consistent with the politics, economy and social situation of
the people. Currently, studying and comparing legal monuments of antiquity, we can conclude that not all laws covered
the legal aspects of society. But they, as a rule of law, mainly regulated the legal relationship between individuals and
the ruling bodies of the state. Despite this, customary law in all countries has positive aspects. Since, on the basis of
these ordinary rights, the legal norms of that society were formed and protected the human right to property, to life and
other rights.
