The article attempts to rethink the theoretical and practical aspects of negative liability, linking it with legal liability. Legal responsibility is a form of social responsibility, therefore, assessing the behavior of a subject through the prism of its social significance, it can be recognized as both socially harmful and socially useful. Based on this, legal research has developed an approach to understanding legal responsibility as positive, consisting in the fulfillment by the subject of legal requirements expressed in lawful behavior. It should be assumed that legal responsibility is an integral element of the legal system, is organically included in the system of social and legal regulation, is aimed at ensuring the lawful behavior of people, collective structures and states, and to fulfill this main goal it is equipped with means of state coercion. The list of distinctive features of legal liability is given, which are compared with the characteristic features of positive liability. Indicates the absence of theoretical grounds for recognizing retrospective (negative) liability as a legal
category and attributing it to legal liability. The theoretical, practical features and factors of the legal structure of society are revealed, explaining the most important aspects of legal responsibility and legal sanctions.
